Proposed amendments to the Tribunal Procedure Rules

This consultation runs alongside the DWP consultation on mandatory consideration before appeal and is seeking views on amendments to Tribunal Procedure Rules.

The two main suggestions are that appeals should be lodged directly with the Tribunal (currently they are sent to the decision maker, for example DWP or HMRC) and that there should be a time limit for appeals submissions to be sent to the Tribunal. Our response is supportive of both suggestions.

We do have some concerns that the benefits of the introduction of a time limit for appeals to be sent to the Tribunal may be undermined if the reconsideration stage, which takes place with the decision maker, is made mandatory without any time limit.
